A “Wrongful Death” case involves a claim made by the family members of a person who was killed by the negligence or intentional acts of another person.  For example, if a truck driver negligently causes an accident on the highway that seriously injures another driver, the victim has a legal claim for negligence against the truck driver.  If the victim dies as a result of the accident, however, the victim is no longer able to assert that claim against the truck driver, so the law allows the victims surviving family members to bring the claim against the truck driver (and maybe his trucking company) for Wrongful Death.

In a Wrongful Death case, the monetary compensation (known as “damages”) that the surviving family members can recover is divided into two categories:  1) economic losses and 2) noneconomic losses.  Economic losses are those to which a number can be easily calculated, such as the medical expenses incurred before the victim’s death, lost wages, and funeral expenses.  Noneconomic losses include less tangible damages suffered by the family members, such as the pain and suffering of losing their loves one.  Colorado has placed a cap on the amount of noneconomic losses that can be recovered by family members in a Wrongful Death case.
